The amount of compensation for pain and suffering in 2025 depends on the type of incident, the severity of injuries, and how well everything is documented. However, the basic principles for determining pain compensation are generally consistent. The extent of compensation is influenced by the number of points assigned based on areas of pain receptors and the intensity of the injury (both the severity of the harm and the affected area are decisive). Here’s an overview of typical amounts and how they are calculated.

What Does Pain Compensation Include in 2025?

The claim covers the actual injury and the intensity of pain you experienced. Compensation primarily concerns the act of harm itself.

Additionally, the claim includes secondary pain caused by medical intervention, for example: surgical procedures such as removal of necrotic tissue or amputation following a crushed limb. This can be counted as a separate claim or as an increase in compensation for the original injury.

You can also claim compensation for ongoing pain. Even during treatment, long-term pain may persist due to the injury. For example, dressings, rehabilitation, or therapy for affected areas may trigger further discomfort.

How Is Pain Compensation Calculated?

The calculation is based on a government regulation (executive decree). Each injury (pain source) is assigned a certain number of points according to pain receptors and the intensity of the injury (e.g., a simple arm fracture = X points, a comminuted arm fracture = XX points).

  • Non-work injuries (civil law cases, e.g., traffic accidents outside work):
    1 point = CZK 461.65 (based on 1% of the average gross wage from the previous year – for 2025 calculated from 2024).
  • Work and school injuries (including occupational diseases):
    1 point = CZK 451.07 (since 2023, the point value is set by government regulation as 1% of the average wage from Q1–Q3 of the previous year; for 2025, calculated from Q1–Q3 2024).

For work/school injuries, the point value and procedure are explicitly defined by Government Regulation No. 276/2015 Coll., as amended by 451/2022 Coll., which links the point value to the average wage.

The final amount of pain compensation is the product of the number of points and the value of each point. In addition, multipliers can be applied through an expert opinion, considering specifics of the injury and individual pain threshold. This allows adjustment for the intensity of pain.

Example Calculation

Scenario: arm fracture in a work injury in 2025, with a medical evaluation of 60 points.

  • Non-work injury → 1 point = CZK 461.65 → 60 × 461.65 = CZK 27,699 (pain compensation).

Points are accumulated for all painful conditions and procedures; additional surgeries or invasive treatments are assessed separately, as are complications, which may increase compensation.

Who Pays Pain Compensation and Where to Apply?

  • Traffic accidents: perpetrator’s mandatory liability insurance (shared liability reduces the amount proportionally).
  • Work/school injuries: employer’s or school’s insurance; procedure and points follow NV 276/2015 Coll.
  • Crimes: perpetrator; in some cases, the state may compensate victims.
  • Medical errors: healthcare provider and their insurer.

How to Maximize Pain Compensation

  1. Document everything from day one: medical reports (including pain intensity and psychological effects), photos of injuries and healing, receipts, and travel to medical appointments.
  2. Accurate point calculation: for severe injuries, consider an independent expert opinion – errors in points can cost tens or hundreds of thousands of CZK.
  3. Negotiate with the insurance company: do not automatically accept the first offer; insist on written justification and comparison with the expert methodology.
  4. Act promptly: deadlines vary by type of claim; avoid delays and handle claims continuously.
